(1)Using 13 Netork, you can determine if a case is a Base Plan or Non-Base Plan. On the "Profile" page in 13 Network, the "Case Profile" table will list "Plan Base" if this case is a Base Plan. If this case is a Non-Base Plan you will not see a "Plan Base" in the "Case Profile" table.
(2)Months to complete may be found using the Calculation of Total Months below. You may also find a calculated (possibly inaccurate) "Months Remaining" in the "Case Profile" table on the "Profile" page in 13 Network.

Calculation of Total Months, Current Month and Remaining Months of a Chapter 13 Case
  1. Cases filed before 10/17/05 - 1st payment is due the first of the month within 30 days after the plan is filed pursuant to 11 U.S.C. § 1326(a)(1).
    OR
    Cases filed after 10/17/05 - 1st payment is due not later than 30 days after the date of the filing of the plan or the order for relief, whichever is earlier pursuant to 11 U.S.C. § 1326 (a)(1).
  2. Calculate the months from the 1st payment due to the month of entry of Order Confirming Plan
    1. plan filed 11/17/02 - 1st payment due 12/02
    2. confirmed 05/22/03 - from 12/02 to 05/03 = 6 months
    3. look at confirmation order to see how many months case was confirmed: - 3rd paragraph of order - if less than 60 months, go to bottom of page to see if the order includes the following paragraph: (ORDERED as follows: that debtor shall pay $__ to the Trustee, Isabel C. Balboa, which represents monies paid prior to confirmation). If so, add the months calculated in (b) to the months listed in the 3rd paragraph of the order for the total amount of months confirmed.
  3. Calculate the current month.
    1. plan filed 11/17/02 - 1st payment due 12/02
      12/02 = 1
      2003 = 12
      2004 = 12
      2005 = 12
      2006 = 12
      Total = 49 months
  4. Deduct the current month from the total months to determine the remaining months left in the plan.
* Please note that if an Order Modifying Debtor(s)' Plan or an Order Resolving Trustee’s Certification of Default and Allowing the Case to Continue has been entered after the Order Confirming Chapter 13 Plan, you will need to refer to these orders to calculate the total number of months of the plan.
